Real Estate Conveyancing
We act for both buyers and sellers of new and used homes throughout Central Alberta. For most first-time homebuyers, the purchase of their first home is an exciting time. However, many homebuyers are surprised by the amount of legal “red tape” and new information they’re faced with in considering their purchase. For many, the most significant financial transaction up to this time may have been the purchase of a vehicle. In such a situation, it is a relatively straightforward and simple exchange of money for property. As you may already know, buying a home is a bit more complicated, but it’s our view that the lawyer’s job is to make your home purchase just as simple. Because this is probably one of the most significant financial events of your life, it is important that you are well informed about the whole transaction. Not only are we the Registered Office for our client company, we also attend to preparing all of the documentation necessary to filing an Annual Return to Alberta’s corporate Registry in order to maintain our clients continued valid status as a company.

Wills & Estate Planning
Having a properly constituted and valid legal will is the cornerstone of your Estate Planning. Many people spent the time and money to ensure that their life insurance is sufficient, their finances are arranged to provide for retirement and subsequent beneficiaries, but then they often forget to do a proper will. Without a valid will, an individuals property would be gifted in accordance with Alberta’s Intestate Succession Act. Contrary to popular misunderstanding however, the government does not get your property if you have no will – rather if you die intestate (without a will) this legislation provides the default rules for who will benefit from your estate.

If you have minor children, special provisions must be made through the contents of your Will to ensure that they and their entitlements are looked after by a Guardian and Trustee of your choosing and appointment. Without a valid Will appointing Guardians and Trustees for minor children, it is ultimately up to the Court to decide who best to look after the child(ren) and their Trust benefits.

There are many traps and pitfalls associated with using off-the-rack “legal will kits”, as well as opting to do your own holographic (handwritten) will: particularly if you have anything but simple gifting provisions. A properly drafted will, prepared by one of our lawyers is the best way to ensure the passing of your estate occurs exactly as you intend.

As part of your Estate plan, we will discuss the necessities of both an Enduring Power of Attorney and a Personal Health Directive. These documents are crucial to determining who will look after your personal and financial affairs in the event you suffer a medical event or injury that leaves you incapacitated.

Estate Freezes and Family Trusts
We have experience with preparing the documentation necessary to the creation of these types of legal entities – which in many cases can be quite complex. Our firm works in consultation with the Client’s accountant or professional adviser in creating these structures with the intent of maximizing tax savings as provided for and allowed by Canada’s Income Tax Act.
Administration of Estates
If you find that you have been appointed the Executor or Personal Representative to someone’s estate – your first thought is that this is a huge and daunting task! To be sure, the administration of an estate creates specific legal duties upon the Executor – as well as an often significant administrative burden connected with the inventory and collection of the deceased’s assets and liabilities, the sale and transfer of same where necessary, and most importantly, the preparation of any and all documentation necessary in an application to the Court of Queen’s Bench for a Grant of Probate and Administration, or any other Court applications that may be necessary in the circumstances in order for the Executor to fulfill their duties.

We have the sufficient expertise and experience to assist the Executor with all facets of administrating an Estate to completion.

  Alan R. Sully

After graduating from the University of Alberta in 1972, Alan moved immediately to Red Deer and has practiced law in this city since that date. During his first twenty years of law he pursued a wide variety of cases and many types of law. Since that time he has focused mainly on solicitors’ work.

Alan has been active in the curling community of Red Deer and served on the Board of Directors for the local curling clubs and as a Director for organizing committees for Canadian and World Junior curling events and for the Canadian Men’s Curling Championship. As well he has coached minor sports and served on and chaired the City of Red Deer Developments Appeal Board. He and his wife Jeanne have also been active in their church and Alan has served as a Board Member for the church.

Alan and Jeanne have three grown children and seven grandchildren.

  T. Kent Chapman

Kent was born and raised in Red Deer. He attended Lindsay Thurber High School and Red Deer College. He completed his BA degree at the University of Alberta and graduated from the UofA Law School in 1981. He returned to Red Deer to practice law.

Kent is experienced in that areas of corporate law, commercial law, real estate, commercial leasing, wills and estate planning, and estate administration. Since graduating, Kent has attended many LESA courses on a regular basis as part of his continuing education.

For a number of years, Kent taught legal courses for Community Programming in Red Deer in the areas of Wills and Estates.

In the area of community service, Kent is a charter member of the Piper Creek Optimist Club. He has held the positions of Director, Secretary, and President. The Piper Creek Optimist Club is affiliated with Optimist International, a well known association of more than 3,000 Optimist Clubs around the world dedicated to being a “Friend of Youth”.

  Kevin A. Beattie

Kevin Graduated law school from the University of Saskatchewan in 1999, and immediately thereafter commenced his articles with a large firm here in Red Deer. He was called to the Bar of Alberta in 2000. Early in his professional career, Kevin received experience in handling all types of legal matters – however it wasn’t long before he decided to focus his area of legal practice to that of a Solicitor.

In addition to his professional life, Kevin is also active in donating time and energy to his community through volunteering with the Kinsmen Club of Red Deer ( Past-President), a Director with the Red Deer Downtown Business Association (Past-President), the Red Deer Leads Executive Club, and other ad hoc volunteer committees.

Kevin also volunteers his time on behalf of Red Deer Public School’s Community Programs, where twice yearly he leads non-credit classes for the public on three topics: Buying and Living in a Condominium; Your Will ( covering the law of will drafting, what consitites a valid legal will and why having one is necessary) and ; Being an Executor of an Estate.

Kevin especially enjoys acting for first-time home buyers, and takes pleasure in assisting these clients through their purchase of their first home. He makes it his personal goal that all of his client’s questions regarding their home and the transaction get answered, problems get solved, and their overall experience is positive and worry-free.
